Unless otherwise specified, the entity controlling the website you are accessing is referred to herein as “Alphabeteer, LLC”, “Site", “Services”, “Program” “we,” “us” or “our”. The term "you" refers to the user accessing the Site, and/or requesting a membership or registration on this Site. Please read the all Terms of Use, Rules and Regulations and Privacy Policy (the "Agreement") that govern your use of the Site, Program and/or Services. Also note that your access to and use of the Site, Programs and/or Services constitutes your legally binding consent to the Agreement and any other Terms set forth through the Site, and all applicable laws, without limitation or qualification. If you do not agree to all of the following Terms of Use, Rules & Regulations and Privacy Policy please do not access or use this Site, Services and/or Programs. You are not authorized to use this Site unless you are at least 18 years of age and able to enter into legally binding contracts.
The relationship between parents and ALPHABETEER, LLC staff is vital to the success of a child´s experience. A partnership must be formed the first day, with open communication and understanding that the development and growth of the child is our top priority. Parents can assist and help ensure a smooth transition by doing the following:
Sign children in and then escort them to their designated classHave all forms completed promptly.Update forms, as needed, when changes occur (i.e. new phone number, address, etc.)Keep staff informed of special needs or changes that might affect your child´s behavior and/or learningDo not bring an ill child to ALPHABETEER, LLCChildren should be dressed properly for the weather and playDo not allow children to bring toys (ALPHABETEER, LLC is not responsible for lost or stolen items)Participate in ALPHABETEER, LLC activities
The following are the rules and regulations governing your participation in ALPHABETEER, LLC Membership and Class Enrollment (“Program”):
To ensure that Program rules are applied consistently and all have the security of knowing what to expect and understand what behaviors are appropriate and desirable, all ALPHABETEER, LLC adults must adhere to the following rules:
5. Avoid corporal, humiliating or frightening punishment. All adults will be expected to adhere to this policy with regard to all children – including their own – while at ALPHABETEER, LLC.
6. Not shout or raise their voice in a threatening way; unless in rare situations where adult is raising their voice in a non-threatening manner in order to prevent/avoid physical injury or harm.
7. Make clear, in cases of misbehavior, that it is the behavior that is unacceptable, not the child.
8. Respect a range of cultural differences and value the contributions and differences of all ALPHABETEER, LLC staff, parents and toddlers.
9. Be aware that different types of behaviors may arise from a child’s special needs.
If a child’s behavior is inappropriate, the following steps will be followed:
We have made every effort to display as accurately as possible the classes, locations, and other information that appear on the Sites. However, we cannot guarantee that all information on the Site will be accurate. In the event a class is listed at an incorrect price or location due to typographical error or other error, ALPHABETEER, LLC, shall have the right to refuse or cancel any registrations for enrollment placed for a class or course listed at the incorrect price/location. ALPHABETEER, LLC shall have the right to refuse or cancel any such registrations to a class or course whether or not the registration has been confirmed and your credit card charged. If your credit card has already been charged for the registration of a class or course and ALPHABETEER, LLC cancels the course/class, ALPHABETEER, LLC shall issue a credit to your credit card account for the amount paid for the course/class.
There is an annual NON-REFUNDABLE membership fee due at the time of registration. Our Program is divided into courses and classes and there are both start and end dates to each course and class. Course/Class tuition are due before the start of the course/class.
At this time, only 1 excused absence, per course, is eligible for a makeup. To be eligible to receive a makeup class within a course, a 24 hour notice must be received via email at funbrainlearning@alphabeteer.com, prior to class An excused makeup class must be completed before the end of the last class in that course.
At this time, there are no make ups for individual classes.
Only excused absences are eligible for a makeup class. There are NO monetary refunds, credits, or pro-rated tuition for unexcused or excused absences. Only 1 excused class absence, per course, is eligible for a makeup.
ALPHABETEER, LLC will not necessarily close for snow days. We may follow CISD, KISD or NWISD. If we do close due to bad weather, we may notify you via the Alphabeteer website or your email on file.
At this time, bad weather days are not eligible for refunds, credits, prorated tuition or make ups.
(it is your responsibility to ensure that our emails are properly delivered to your mailbox and not blocked by your anti-spam software or other protection measures).
If a check is returned to ALPHABETEER, LLC due to insufficient funds, the individual will be notified via email. Full restitution for a check returned due to insufficient funds, including an insufficient fund charge of $38.00, must be received before relevant deadlines. Appropriate penalties will be imposed and must be included, if restitution is received after the identified deadline. Acceptable methods of payment are MasterCard or Visa, cash or money order. ALPHABETEER, LLC reserves the right to suspend check writing privileges for future ALPHABETEER, LLC payments for this and/or any reason.
Parent/Gaurdian hereby agrees that if a check is written with insufficient funds or if parent/guardian is late with payments, ALPHABETEER, LLC has the option to require automatic credit or debit card payments from that point forward.
VII. exchange or credit of products
If a purchased ALPHABETEER, LLC product proves to be defective or not to your reasonable satisfaction, you can return the product within 3 days with the original receipt. In such event, you may exchange the product for one of equal or lesser price or you can receive credit toward the purchase of an ALPHABETEER, LLC product. Credit from product returns cannot be used toward the purchase of ALPHABETEER, LLC individual classes or courses or membership.
VIII. Cancellation of course/individual class
If parent/guardian wishes to cancel an existing course or individual class, it must be done via email at funbrainlearning@alphabeteer.com. A cancellation form will be emailed to the main email address on file. Before cancelling an account and deleting data, ALPHABETEER, LLC must first verify ownership of the account. Therefore, ALPHABETEER, LLC WILL NOT ACCEPT any other form of cancellation including but not limited to fax, postal mail, phone or text.
All cancellations must be received at least 48 hours prior to the start of the course, the class in a course or individual class, to be eligible for a prorated or full refund (whichever is applicable). If an email cancellation is not received at least 48 hours prior to the beginning of an individual class, parent/guardian forfeits the tuition for that class and no refund will be given. If an email cancellation is not received at least 48 hours prior to the beginning of the course or class in a course, a charge will be assessed for that class and only the prorated tuition from any remainder classes will be refunded.
ALPHABETEER, LLC reserves the right to deny membership/enrollment for repeated cancellations.
ALPHABETEER, LLC Membership fees are non refundable
There are NO refunds, credits, or pro-rated tuition for previous and/or previously attended classes.
ALPHABETEER, LLC, reserves the right to terminate this agreement and/or terminate, suspend or otherwise restrict use of and access to the Program or any portion hereof, immediately, with or without notice at any time for any reason whatsoever, with or without cause, including, but not limited to, your violation of Terms of Use, Privacy Policy and/or Rules and Regulations or any inappropriate or unlawful behavior on your part or if in ALPHABETEER, LLC, sole discretion you fail to comply with any term or provision of this Agreement.
Medical Emergency
Parent/Guardian gives permission to ALPHABETEER, LLC its owners and operators to seek medical treatment or attention for your child/children in the event parent/guardian is unable to call the emergency contact, as may be required by the circumstances, including without limitation, that of a licensed medical physician and/or a hospital, as well as the power to authorize medical treatment or medical procedures in an emergency situation. In case of an emergency, parent/guardian agrees to provide ALPHABETEER, LLC with their child’s/children’s emergency contact, in writing.
X. RELEASE OF LIABILITY Damages and Injuries
You expressly understand and agree that to the extent permitted by applicable law, your use of the Program is at your sole risk and the Program is provided on an “as is” and “as available” basis, with all faults. ALPHABETEER, LLC, its teachers and other staff members will not be liable or responsible for any direct, incidental, consequential, indirect or punitive damages or injuries, deletion of and/or delays in operation.
You hereby consent to have your child/children participate in the Programs offered by ALPHABETEER, LLC, and hereby assume full responsibility for personal injury to yourself and your child/children, and further release and discharge ALPHABETEER, LLC, from injury, loss or damage arising out of you or your child’s/children’s use of or presence upon the facilities of ALPHABETEER, LLC, whether caused by your fault, your child’s/children’s fault, ALPHABETEER, LLC, or other third parties.
You hereby declare any physical/mental problems, restrictions, or condition and/or declare the participant to be in good physical and mental health to participate in the ALPHABETEER, LLC, program.
XI. Indemnification
As the legal parent or guardian, I hereby release and hold harmless ALPHABETEER, LLC, its owners, managers, officers, directors, affiliates and operators from any and all liability, claims, demands, and causes of action whatsoever, arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, and/or my child/children, while in or upon the premises or any premises under the control and supervision of ALPHABETEER, LLC, its owners, managers, officers, directors, affiliates and operators or when in transit to or from any of said premises.
I agree not to bring any type of suit, claim, or complaint, in law, equity, or through an administrative agency, for costs, expenses, principal, interest, fees or otherwise, against ALPHABETEER, LLC, its owners, officers, directors, employees, agents, subsidiaries or affiliates with respect to the Program and instruction at ALPHABETEER, LLC, or any contractual matter between parent/guardian and ALPHABETEER, LLC, its owners, managers, officers, directors, affiliates and operators.
You hereby certify that you are the parent and/or guardian of the minor child(ren) under eighteen years of age, and you hereby grant full and irrevocable consent to ALPHABETEER, LLC, and its successors and assigns and those acting under its permission to reproduce, copyright, publish, circulate or otherwise use your name, the minor child(ren)'s name, and/or photographic likenesses of you and/or the child(ren) named on this registration form as single, multiple, or moving images in which you or the minor child(rent) may be included in whole or in part, or composite. You waive any right to inspect and approve the finished product or copy that may be used or the use to which it may be applied.
This authorization and release covers the use of said materials in any published, broadcast, or electronic form, and in any medium of advertising, publicity, or trade in any part of the world in perpetuity. You understand that pictures and video footage of you and/or your child(ren), as well as other members of your family, may be posted/displayed, viewed in group meetings, and printed in agency newsletters. You understand that these pictures may be used in other media outlets, such as newspapers or magazines.
Furthermore, You for yourself, your heirs, executors, administrators, or assigns, transfer to the organization, its successors and assigns, all your rights, title, and interest in and to such materials to ALPHABETEER, LLC and its successors and assigns.
This agreement represents in full all terms and considerations with respect to the subject matter hereof, and no other inducements, statements, or promises have been made to you. These images will be used for ALPHABETEER, LLC, purposes only, and will not be given or sold to outside companies or individuals.
You agree and acknowledge that you are under no pressure or duress to consent to this Agreement and that you have been given a reasonable opportunity to review it. You further agree and acknowledge that you are free to have your own legal counsel review this Agreement if desired.
